PRIVACY POLICY

DEFINITIONS:

"Candidate" means an unlicensed paralegal student who is currently enrolled in or has completed or graduated from a paralegal program at a post-secondary learning institution, accredited by the Law Society of Ontario AND who is officially registered with the Law Society as a P1 Candidate, with a valid P1 Candidate number.

"Company" mean N.Joy Publishing Inc. operating as Pretty Paralegal.

"Licensee" means either a licensed paralegal or lawyer whose membership in the Law Society of Ontario is in good standing; and who is either licensed to provide legal services or practice law.

"Law Society"  (and "LSO") means the Law Society of Ontario and Law Society of Upper Canada.

"Pretty Paralegal" is the operating trade name and trademark licensed to, and under which N.Joy Publishing Inc. conducts business and provides services to the public. 

"Pupil" means the Candidate or Licensee who is enrolling in the Pretty Paralegal Pupillage.  

"Student" means a person who is enrolled at an LSO Accredited College for Paralegal Studies, and who has not yet graduated nor received their paralegal diploma / degree.


GENERAL:

Pretty Paralegal recognizes the importance of privacy and the sensitivity of personal information.  It is part of our fundamental commitment to you, to provide good quality, legal education and support services at a reasonable cost.  As an organization that is owned and operated by licensed members of the Law Society of Ontario, Pretty Paralegal is committed to keeping confidential, all information it receives . This Privacy Policy outlines how Pretty Paralegal intends to manage your personal information and safeguard your privacy.

THINKIFIC PRIVACY POLICY

The Pretty Paralegal Pupillage and all programs and courses provided are done so through the Thinkific.com online platform.  As such, the Thinkific.com privacy policy includes and forms part of the Pretty Paralegal Privacy Policy, and can be found here:  https://www.thinkific.com/privacy-policy/ 

YOUR PRIVACY RIGHTS

As of January 1, 2004, all businesses engaged in commercial activities must comply with the Personal Information Protection and Electronic Documents Act, (“PIPEDA”) unless the Federal Government has exempted the organization because it is subject to substantially similar provincial legislation. To date, licensed members of the Law Society and their partnerships or associations in Ontario are not exempted and Ontario has not enacted any substantially similar legislation to PIPEDA. Therefore, although no paralegal-client / no solicitor-client relationship exists between you and the Company, Pretty Paralegal shall nevertheless be subject to PIPEDA, which gives you rights concerning the privacy of your personal information.

WHAT PERSONAL INFORMATION DO WE COLLECT?

Personal information is any information that identifies you, or allows you to be identified, including such information as your home address/phone/email, billing information, credit information, family information, ethnicity, sexual orientation, blood type, medical information and personal financial information. Personal information does not usually include business contact information such as your name, title, employer/organization, or business address, phone/fax number or email. For the purposes of this privacy policy, personal information has the same definition as in the controlling legislation. We must obtain some personal information in order to provide you with legal education services. If we did not collect and use personal information we could not provide you with those services. We only collect that personal information which is reasonably necessary for our commercial relationship.

WHY DOES PRETTY PARALEGAL NEED PERSONAL INFORMATION?

Pretty Paralegal provides legal education services and products to unlicensed, but registered paralegal candidates (in the licensing process) and licensed members of the Law Society of Ontario. We collect personal information about and from our Pupils in order to:

 INFORMATION?

We collect information only by lawful and fair means. Wherever possible we collect your personal information directly from you, including but not limited to when you join the Pretty Paralegal Pupillage and create your free account; when you pay for enrollment in a paid program or course and in connection with your participation in one of our programs or courses; at the start of a Business development contract, if Pretty Paralegal's services are privately engaged and in connection with that engagement, where applicable.

CONSENT

By submitting personal information to Pretty Paralegal, or its service providers, agents or anyone else on its behalf, you agree that we may collect, use and disclose such information according to this privacy policy. If you provide Pretty Paralegal, or its service providers, agents, or anyone on its behalf, personal information about anyone else, by giving us such information, you represent to us and confirm that you have obtained all necessary authority and or consents from that other person to enable us to collect, use and disclose that personal information according to this privacy policy.

In addition, if you engage Pretty Paralegal to provide you with business development services for your firm / legal services practice, you will be required to sign a separate Engagement Letter / Retainer Agreement in which you give us your express consent to collect, use and/or disclose personal information about you during the course of our providing you with business development services, as we determine may be necessary in order to fully assist you.

USE OF YOUR INFORMATION

Pretty Paralegal may use your personal information to confirm your eligibility to join the Pupillage and to participate in our programs, courses and events; to  be compliant with Law Society record-keeping requirements (for providers of CPD accredited programs and courses); to communicate with you, and to include you in any direct marketing activities. In these respects, we assume that we have your consent to use your personal information unless you advise us to the contrary. If you tell us that you no longer wish to be a Pupil in the Pupillage nor receive information about our services, nor subscribe to nor receive updates on new blog posts, nor or about new developments in the law, we will not send any further material.

Pretty Paralegal, shall not disclose your personal information to any third party to enable them to market their products and services without your consent. For example, Pretty Paralegal shall never provide our Pupil contact lists to anyone, except as may be required by law.

UPDATING YOUR INFORMATION

Since we use your personal information to provide legal education and business development services to you, it is important that the information be accurate and up to date. If during the course of your pupillage, any of your information changes (such as, if you are a candidate who becomes licensed or if you cease to be a member of the Law Society of Ontario, either as a candidate or licensee), please inform us so that we can make any necessary updates.

ACCESS TO YOUR PERSONAL INFORMATION

When you create your Pretty Paralegal account, you will have complete access and ability to personally update your information. You may also ask for a reporting of any personal information we hold about you. Summary information is available on written request. More detailed requests that require archive or other retrieval may be subject to additional costs.

HOW LONG DO WE KEEP PERSONAL INFORMATION?

We keep personal information for as long as is reasonable in order to conduct our business with you, or longer, if required by law.

CORRECTING ERRORS

If we hold information about you and you can establish that it is not accurate, complete and/or up to date, we will take reasonable steps to correct it.

CAN I BE DENIED ACCESS TO MY PERSONAL INFORMATION?

If we deny your request for access to information, or refuse a request to correct information, we shall explain why.

Pretty Paralegal may only request your phone number, address and photo ID or other documentation to identify you (such as a copy of your Law Society membership card) if you engage our services for in-firm business development services / coaching.

COMMUNICATING WITH PRETTY PARALEGAL

Pretty Paralegal communicates with Pupils primarily through email, however, you should be aware that email is not a 100% secure medium, and you should be aware of this when contacting us to send personal or confidential information. For this reason, we also recommend that you do not send emails to Pretty Paralegal on a work or public computer or from an employment email account that may be owned and controlled by a third party.

EMPLOYMENT INQUIRIES

Often, Pupils will apply to Pretty Paralegal for contract / teaching / coaching work. In such cases, we need to consider your personal information as part of our review process. We normally retain information from candidates after a decision has been made, unless you ask us not to retain the information. If Pretty Paralegal offers you a job, or independently engages your services and if you accept, the information will be retained in your confidential employee / independent contractor records (whichever applies).

Our website may contain links to other sites which are not governed by this privacy policy.

We may collect personal information through our website, but only when you voluntarily enter the website, submit a form electronically, use links contained on the website or send us email. When you provide information to us through these mechanisms, you consent to our collection, use and disclosure of such information according to this privacy policy. Personal information provided through these mechanisms will be used only for the purpose(s) for which you submitted the personal information, to respond to you, and to send you information from time to time that we think may be of interest to you.

We may monitor traffic patterns, site usage and related site information in order to optimize our web service. We may provide aggregated information to third parties, but these statistics do not include any identifiable personal information.

CHANGES TO THIS PRIVACY POLICY

Pretty Paralegal regularly reviews all of its policies and procedures. We may change our Privacy Policy from time to time. Please review our Pupillage occasionally, to keep abreast of any changes.
